Stoltz Marketing Group Privacy Policy

SMG, Inc. (dba Stolt Marketing Group) (sometimes referred to herein as “Owner”), the owner and operator of the website located at https://www.stoltzgroup.com/ (the “Site”), recognizes that its customers, visitors, users, and others (sometimes referred to herein collectively or individually as a “User” or “Users”) who use the Site value their privacy. This Privacy Policy details important information regarding the use and disclosure of Users’ information collected on the Site or other websites owned or operated by the Owner (collectively, the “Owner Sites”). The Owner provides this Privacy Policy to help you make an informed decision about whether to use or continue using the Owner Sites. By virtue of User’s accessing and use of any or all of the Owner Sites, User is agreeing to the term of this Privacy Policy and the terms and conditions set forth herein. If at any time during or after User’s use of the applicable Owner Sites User does not agree with this Privacy Policy or the terms and conditions set forth below, please contact the Owner via the Site. This Privacy Policy is governed by the laws of the State of Idaho, U.S.A.

  1. Personal Information Owner Collects

    When you visit the Owner Sites, the Owner automatically collects certain information about User’s device, including information about User’s web browser, IP address, time zone, and some of the cookies that are installed on the User’s device. As User browses the Owner Sites, we collect information about the individual web pages or products that User views, what websites or search terms referred User to the Owner Sites, and information about how User interacts with the Owner Sites. The owner refers to this automatically-collected information as “Device Information.”

    The Owner collects Device Information using the following technologies:

    • “Web beacons,” “tags,” and “pixels” are electronic files used to record information about how Users browse the Site.

    The Owner Sites collects information, which may include personal data, from User’s browser when Users use the Owner Sites. The Owner uses a variety of methods, such as cookies and pixel tags to collect this information, which may include your (i) IP-address; (ii) unique cookie identifier, cookie information, and information on whether your device has software to access certain features; (iii) unique device identifier and device type; (iv) domain, browser type and language, (v) operating system and system settings; (vi) country and time zone; (vii) previously visited websites; (viii) information about your interaction with Owner Sites such as click behavior, and indicated preferences, and (ix) access times and referring URLs.

    The Owner also collects personal User data submitted by such Users, including but not necessarily limited to, names and email addresses. If you submit personally identifiable information to Owner, then the Owner may use your personal information to operate, maintain, and provide to you the features and functionality of the Owner Sites and for the same purposes that Owner uses the Device Information. Any personal information that you voluntarily disclose online or otherwise submit for distribution may be, or may become, publicly available and may be collected and used by others. Your account name (not your email address) and certain other non-confidential information may be displayed to other Users through the Owner.

    Third parties may also collect information via Owner Sites through cookies, third party plug-ins, and widgets. These third parties collect data directly from User’s web browser and the processing of this data is subject to the third-party’s own privacy policies.

    The Owner uses cookies and pixel tags to track Users’ usage of the Owner Sites and to understand our customers’ preferences (such as country and language choices). This enables us to provide services to Users and improve their online experience. The Owner also uses cookies and pixel tags to obtain aggregate data about site traffic and site interaction, to identify trends and obtain statistics so that the Owner can improve its Site. There are generally three categories of cookies used on Owner Sites:

    Functional: These cookies are required for basic site functionality and are therefore always enabled. These include cookies that allow Users to be remembered as they explore Owner Sites within a single session or, if a User requests, from session to session.

    Performance: These cookies allow the Owner to improve Owner Sites’ functionality by tracking usage.     Social media and Advertising: Social media cookies offer the possibility to connect you to your social networks and share content from our Sites through social media. Advertising cookies (of third parties) collect information to help better tailor advertising to your interests, both within and beyond our Sites. In some cases, these cookies involve the processing of your personal data. Refusing these cookies may result in seeing advertising that is not as relevant to you or you not being able to link effectively with Facebook, Twitter, or other social networks and/or not allowing you to share content on social media.

    You can also choose to have your computer warn you each time a cookie is being sent, or you can choose to turn off all cookies. You do this through your browser settings on each browser and device that you use. Each browser is a little different, so look at your browser Help menu to learn the correct way to modify your cookies. If you turn cookies off, you may not have access to many features that make our Sites and Apps more efficient and some of our services will not function properly.

    When we talk about “Personal Information” in this Privacy Policy, we are talking both about Device Information.

  2. Use of Information

    The Owner uses the information it collects about a User to provide, maintain, and improve the Owner’s services and the other interactions it has with you as User. For example, the Owner uses the information it collects as follows:

    • Owner uses the Device Information that Owner collects to help screen for potential risk and fraud (in particular, User’s IP address), and more generally to improve and optimize Owner Sites (for example, by generating analytics about how Users browse and interact with the Owner Sites, and to assess the success of Owner’s marketing and advertising campaigns).
    • comply with Owner’s legal and financial obligations;
    • monitor and analyze trends, usage, and activities;
    • tailor the content and information that Owner sends or displays to User, offer location customization and personalized recommendations, help, and instructions, and otherwise personalize your experience while using Owner’s Services;
    • provide advertising and marketing targeted toward User’s interests;
    • Any personal information that User voluntarily discloses online or otherwise submit for distribution becomes publicly available and can be collected and used by others. User’s Your account name (not email address) and certain other non-confidential information may be displayed to other Users through the Owner.
  3. Sharing of Information

    Owner provides personally identifiable information and non-personally-identifiable information to other businesses or persons for the purpose of processing such information on Owner’s behalf. Owner requires that these parties agree to process such information in compliance with our Privacy Policy, and we use reasonable efforts to limit their use of such information and to use other appropriate confidentiality and security measures. Owner does not rent, sell, or share personal information about Users with other people or nonaffiliated companies except to provide products or services that they User has requested when Owner has your permission using Owner’s opt in/out option. Owner provides the information to trusted partners who work on behalf of or with Owner under confidentiality agreements. These companies may use a User’s personal information to help Owner communicate with the User about offers from Owner and its marketing partners. However, these companies do not have any independent right to share this information.

    Owner will transfer information about Users if Owner is acquired by or merges with another company.

    Owner may share personal information about Users to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful requests for information Owner receives, or to otherwise protect Owner’s rights.

    As described above, Owner uses a User’s Personal Information to provide the User with targeted advertisements or marketing communications that Owner believes may be of interest to the User.     Please note that we do not alter our Site’s data collection and use practices when we see a Do Not Track signal from your browser.

    Please be advised that through your continued use of the Owner Sites, which are governed by U.S. law, and these terms, that you are agreeing to be bound by the laws of this territory and by transferring your personal information to the United States, you consent to that transfer.

    Use of Stoltz Marketing Group Site is not intended for and may not be used by individuals under the age of 13 located in the United States or under the age of 16 if located outside of the United States (or under a lower age if permitted by the laws of their residence). Stoltz Marketing Group does not knowingly collect personal data from minors or allow them to register accounts.
